The agency

Duties that sit on the business itself, regardless of how many properties it manages.

  1. Is the agency a member of a government-approved Client Money Protection scheme, with the certificate displayed in the office and on the website?
  2. Is the agency a member of an approved redress scheme (The Property Ombudsman or the Property Redress Scheme), with membership shown on fee displays?
  3. Do you hold, for every landlord you manage, the documents needed for Private Rented Sector Database registration — and a plan for who registers when it opens?
  4. Have your tenancy agreements, notices and possession process been updated for the Renters' Rights Act — periodic tenancies, Section 8 grounds, Section 13 rent increases?

Every property you manage

Answer for the portfolio as a whole: “yes” means you could evidence it for every property today.

  1. Does every tenant receive the current version of the government's How to Rent guide at the start of the tenancy, with a record of when it was served?
  2. Is every deposit protected in an approved scheme within 30 days, with the prescribed information served and the evidence filed?
  3. Is a Right to Rent check completed and recorded for every adult occupier before the tenancy starts, with follow-up checks diarised for time-limited permission?
  4. Does every property with a gas appliance have an in-date Landlord Gas Safety Record, with the next check booked before the deadline and copies served on tenants?
  5. Does every property have a satisfactory EICR less than five years old, with any C1, C2 or FI items remedied within 28 days?
  6. Does every property have a valid EPC of band E or better, served on the tenant before they sign, with a plan for band C by 2030?
  7. Are there working smoke alarms on every storey used as living accommodation, and a carbon monoxide alarm in every room with a fixed combustion appliance other than a gas cooker, tested and recorded at the start of each tenancy?
  8. Has a legionella risk assessment been carried out and recorded for every property, and reviewed when the water system or occupancy changes?
  9. Where a property is an HMO — or sits in an additional or selective licensing area — is the licence in place, in date, and its conditions being met?
